Terms of Enrollment, Liability Waiver, Photo Release, and Company Policy Agreement

Notice to Participant

By purchasing or enrolling in a course, you acknowledge and agree to the following terms, conditions, and legal disclaimers. Your participation constitutes your voluntary consent and full acceptance of all risks, responsibilities, and policies outlined below.

SECTION 1: ASSUMPTION OF RISK & PARTICIPATION ACKNOWLEDGMENT

I understand that participation in CPR, AED, and First Aid training includes physical activity and close contact, including but not limited to:

  • Kneeling, standing, or lying on the ground
  • Performing chest compressions on a manikin
  • Using training AED and first aid devices
  • Moving between stations and classroom setups


These actions may present risks of:

  • Muscle strain or joint discomfort
  • Back or knee pain
  • Dizziness, fainting, or fatigue
  • Slips, trips, or falls
  • Exacerbation of existing conditions



I affirm that I am physically and medically capable of participating and that I will communicate any limitations to the instructor prior to starting the course.

SECTION 2: COVID-19 & COMMUNICABLE DISEASE NOTICE

I understand that despite all precautions, CPR training involves close proximity to others and shared equipment. I acknowledge the risk of exposure to COVID-19, influenza, or other communicable illnesses.


I agree to:

  • Stay home if I feel sick, test positive, or have symptoms of contagious illness
  • Follow any mask or health screening protocols if required
  • Assume full responsibility for any illness or exposure resulting from class participation

SECTION 3: RELEASE OF LIABILITY & INDEMNIFICATION

In consideration of participation, I voluntarily agree to release, waive, and indemnify the following:

  • Michael R. Bisogna
  • CPR & First Aid Training Center, LLC
  • All affiliated instructors, contractors, training centers, and instructor assistants
  • The facilities where training is conducted, including but not limited to:

• Manalapan Township Fire Company #1

• 20 Gibson Place, Freehold, NJ

• Any client-provided location (e.g., homes, schools, gyms, businesses)


I waive all claims for:

  • Personal injury, illness, or medical events
  • Property loss or equipment damage
  • Exposure to infectious disease
  • Improper or unsuccessful use of CPR, AED, or First Aid skills post-training
  • Slips, falls, or accidents during training sessions


This waiver applies even in cases of negligence by the released parties, to the extent allowed by law.

SECTION 4: PHOTO / VIDEO RELEASE

By attending the course, I authorize CPR & First Aid Training Center, LLC to:

  • Photograph, film, or record me during training
  • Use these images or footage for marketing, educational, or promotional purposes
  • Publish them online, on social media, or in printed materials


I waive any rights to payment or claims related to such use.

(If I wish to opt out, I must inform the instructor in writing before class begins.)

Section 5: Company Policies

Certification Requirements:

  • Successful completion of all required hands-on skills and written testing is required for certification.
  • No card will be issued to participants who do not pass or do not complete the course.
  • Certifications will be issued via digital AHA eCard within 7 business days after successful completion or sooner. Ecards are usually issued within 1 business day.

 

Payments, Refunds, and Cancellations:

  • Payment is due in full prior to the start of the course unless otherwise arranged.
  • Refunds are not issued for:
  • Cancellations made less than 24 hours before the class
  • No-shows
  • Failure to pass required skills
  • If class is canceled or rescheduled by the instructor (e.g., due to emergency or weather), participants may receive a full refund or rebooking.


Code of Conduct:

  • Disruptive or disrespectful behavior may result in dismissal without refund.
  • Participants are expected to treat staff, equipment, and fellow students respectfully.
  • Any damage to equipment caused by misuse or negligence may be the participant's financial responsibility.
